| Hi, My name is Ken Rohling and I'm now a non-custodial parent who has been battered to within inches of my life by the very system that is supposed to protect my rights as a citizen and uphold the law. I've spent my entire professional life trying to help others by creating new medical devices and improving medical imaging technologies. I apparently spent too much time in the lab to know what REALLY can happen to a loving father at the hands of a malicious and corrupt system called "Family Court" in New York State. I was blindsided by the local judiciary, foolishly expecting them to do the right thing and follow the law. Sorry...Doesn't happen. This is NOT what we were taught in school, we're not in Kansas anymore, Toto. Read on for part of my story, it's amazing that this can happen in a country where we pride ourselves in the protection of our Civil and Constitutional Rights. And, my story is tame compared to most. One curious thing I noticed about the Judicial system, is that we have put people who do NOT have to know or understand the law (town courts) into a position where they make judgements against people, judgements based on laws that they do not have to know or understand. These judgements can have the most dire consequences imaginable, they can destroy your children, they can KIDNAP them, they will destroy you. For some people who have lost all hope, these are life and death judgements. The highest rates for suicides is among men who are going through this system (much more about that later) But, If you're near that point, and have been having thoughts along those lines, PLEASE SEEK HELP NOW !! A good psychologist, psychiatrist, family doctor, or even a friend. Do NOT hold it all in and try to go it alone, it won't work, and at the very least, it will destroy you mentally. The extreme sense depression that you will be left with from them kidnapping your children away from you is incredibly overwhelming. Back to the issue... We have put these people in this position where not only do they NOT have to know the law, they don't even have to FOLLOW it. And, to top it off, we have made them immune to all of these laws, there is no one that they are accountable to. (much more about this later too - the commission on Judicial Conduct) They, at the crack of a gavel, can take away your children, all of your possessions, and all that you've strived for... on a WHIM !! They don't need facts, they don't even need a reason. They can do it just because they WANT to (Click to play), or because they don't LIKE you, or just because they had a bad day at their real job, and they are miserable and tired. It doesn't matter what the reason is, they don't even have to tell you the reason... and there's nothing you can do... about any of it. I thought I was an isolated case, but this behavior is RAMPANT. There are hundreds of thousands, probably millions of people who have become victims of this kind of organized abuse. Speak out !! Contact us, and tell your story. Eventually, they will HAVE to listen. I don't believe that the founders of this country meant it to be this way, this behavior is nothing short of CRIMINAL. Another silly thing: They will allow a person to be a Judge without being a lawyer. He can do just about anything he wants to you as a lay Judge. However, I can't have a person speak in Court on my behalf if they DON'T have a law Degree. I was told by one of the Judges that according to Section 16, or something to that effect, they can't have a non-lawyer practicing LAW. How come you guys can do it and I can't??? Timeline Sept 05, 2003 - Sept 09, 2003 (Word File) (PDF) 09/06/03 I was arrested, handcuffed in front of my children, and charged with Criminal Mischief in the 4th Degree even though I can't be arrested, or prosecuted for this crime. It was my property. . (Image-1) 09/07/03 - Kids have "emergency meeting" with Susan Kahn, an unlicensed Social Worker who also just happens to have direct ties to the domestic violence shelter, Unity House, and VERY close ties to Judge Gilbert Abramson. 09/09/03 - Susan Kahn faxes a letter to Elizabeth Donehue (a week before my wife retains her), who forwards it to Judge Abramson. This is already facing me in court, and I have no knowledge of it. 09/09/03 - Renee Rohling writes a letter to Judge Kissinger and it is presented to the Judge ex-parte. Susan Kahn states in her letter: "I had to instruct Renee to get Orders of Protection for her and the children..." 09/10/03 I was arraigned in front of Judge Keith Kissinger, Town of Ballston Court. 09/10/03 I was served an Order of Protection by the Judge barring me any contact with my wife, Renee Rohling (OOP-1) 09/10/03 I was called in the evening, and was requested to meet the Saratoga County Sheriff's Deputy at Stewarts in Rexford, NY. so that he could serve me with another Order of Protection. He makes ME meet him, so he can serve ME papers, papers that execute me as a father to my children. That act in itself should be illegal. OOP-2 This ONE piece of paper, served me improperly by the Sheriff's Department, and Written up by Judge Keith Kissinger, has banned me from seeing my children, and them from seeing me. We can't call each other, we can't write each other, I can't even have someone else call them, just to tell them that I love them. And all this done on a baseless allegation, with no proof, or any chance for my side of the story to be heard. 09/10/03 - Tape of Deputy delivering OOP (Excerpt 1) (Excerpt 2) (Full MP3) 09/11/03 - Tape of interview with attorney Mastro (Excerpt 1) (Excerpt 2) (Excerpt 3) (full MP3) 09/24/03 - Attorney Margret Villa and I appeared in front of Judge Kissinger. I had proof of ownership of the house in hand. We asked for a dismissal of the charge, since there was no basis for it, and an ammendment to the Order of Protection. The Judge would not grant either request, wouldn't even address the matter of ownership of the property. 10/01/03 - Deborah Fellows and I hand delivered a letter to the ADA's office (Debora Kaelin) asking for help on this matter. She refused seeing us, but we were assurred that she would get and read the letter. (Word File) (PDF) 10/01/03 - I tried to get a copy of the affidavit and the application for the second Order of Protection from the law clerk so I could understand what prompted this unwarrented persecution from Judge Keith Kissinger. (Excerpt 1) (Full MP3) 10/01/03 - I tried to have a conversation with the Assistant District Attorney, Deborah Kaelin as she entered the Courthouse. She already knew at this time that I owned the house from the letter, and already knew that the charges were invalid. The conversation was recorded. (Full MP3) 10/07/03 - My Attorney, Dennis Englert, sent a letter to Judge Kissinger, cc to ADA Deborah Kaelin indicating to them that the Orders of Protection against me were clear violations of "due process" and that a hearing be granted me on the 15th of October. (Letter 10/07/03) On the recipt of this letter by Judge Kissinger and ADA Deborah Kaelin, Both of them were FULLY aware that not only were the charges against me illegal, the Orders of Protection were obtained by violating my rights to "Due Process" 10/15/03 - I appeared again in front of Judge Kissinger, this time with Greg Shaaf, standing in for my attorney, Dennis Englert. Greg had a meeting with ADA Deborah Kaelin behind closed doors. They ALWAYS seem to want to do their deeds behind closed doors. Greg came out and gave me their offer. It didn't matter to the judge or the ADA that this charge is unfounded in law, and the law is spelled out clearly in black and white, with case law from the (to be filled in tomorrow) backing it up. It didn't matter to them. Their offer to me was an ACOD (adjournment in contemplation of dismissal), if I accepted it, they would drop the Order of Protection. That was the deal. If I was such a threat to the safety and well-being of my children, then WHY would my accepting the ACOD magically change that? It was a clear attempt by the Ms. Kaelin to coerse me into accepting their offer, to get me to admit to something they were wrong in charging me for in the first place, bartering with me with my children and holding them hostage from me. I refused the ACOD, and the Judge, the ADA, and my attorney went back in for discussions based on my answer. The meeting broke up with the understanding that they would all then proceed to the courtroom, and my attorney would then request the dismissal. Ms. Kaelin headed out the door. Judge Keith Kissinger dismissed the charges, but REFUSED to vacate the Protection Order despite being reminded that they can't have an Order of Protection against someone without valid charges against them. The Judge again refused to tell me why the OOP was placed against me. All of a sudden, I've somehow become a DANGER to my children again and will NOT be allowed to see, or communicate with them, even though moments ago, if I were to agree to an ACOD, I wouldn't have been a threat to my kids, and it would have been OK. Hostages...my children are now HOSTAGES !!! 10/16/03 - "Honorable" Keith J.Kissinger wrote a letter to my lawyer explaining (from his point of view) what was going on with this case. Supplemental info and supporting documentation to be added here 10/??/03 ADA Kaelin wrote a letter stating that the "people" had no input to the dismissal, even though she ran from the proceedings, the charge was reinstated, and the OOP kept. Eventually the charge was dropped again, The OOP was kept in place, new charges of harassment were filed for the same incident. I was still deemed a threat to my kids and couldn't see them. But, I was again offered an ACOD with them using my kids as bargining chips. Again, if I accepted, I wouldn't be a threat to them and the OOP would have been modified. Requested dismissal of the charges, ACOD offered again, went to trial (mar?). Two written ex-parte communications and at least one verbal communication were used by Renee and the Judge against me. illegal, but successful at barring me of all contact with my children.
